Maintestream Electronic Communications Agreement
MAINTESTREAM ELECTRONIC COMMUNICATION AGREEMENT
This Electronic Communication Agreement (“Agreement”) is made by and between
Maintestream, operated by King Invo LLC and Recipients, Recipient, and/or Parties as described below, as well as anyone who accesses and uses Maintestream its platform, systems and third party systems.
By accessing or using Maintestream’s website, products, services, systems, and any associated third-party platforms, systems and/or integrations (collectively, the “Services”), you (“you” or “User” collectively, "Recipients" and individually, a "Recipient") who are authorized representatives,
employees, agents, managers, contractors or owners who are or are affiliated with Maintestream and/or a Maintestream Client (such as but not limited to property owner(s, landlord(s, property manager(s, property management company(s, service provider(s, service company(s, technician(s, contractor(s, subcontractor(s, and/or 1099 contractor(s), hereinafter referred to as the “Parties.” agree to be bound by the following Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use our Services.
Maintestream reserves the right to update or modify these Terms at any time. Continued use of the Services following any changes constitutes your acceptance of the revised Terms.
1. Purpose of Agreement
This Agreement serves to obtain informed and voluntary consent from the
Recipients/Parties to receive electronic communications via automated systems including, but not
limited to:
• Text messages (SMS or MMS)
• Emails
• Automated call notifications (if applicable)
All communications shall pertain strictly to:
• Tenant maintenance request notifications
• Status updates, scheduling coordination, invoices or estimates, tenant move out notices,
new tenant applications, new tenant pre-approval applications, showings, showing
surveys, notifications
• Platform updates or service information directly tied to Maintestream activity
2. Nature of Communications
Communications may be sent through third-party platforms, automated software systems, and
integrated notification services used by Maintestream. These communications are:
• Not for marketing purposes
• Intended solely for operational services between Maintestream and its Clients’ authorized
personnel
• Sent to the mobile phone numbers and/or email addresses provided by the Recipients
below
3. Consent to Receive Messages
By accessing Maintestream's Services, each Recipient expressly consents to:
• Receiving automated emails and text messages from Maintestream and its technology
providers.
• The use of automated dialing systems, prerecorded voice messages, and third-party
messaging platforms as necessary to fulfill service obligations.
• Receiving messages any day and time of the year as requests, services and updates are
submitted by tenants and/or forwarded by and/or generated by Maintestream systems,
affiliates, employees and/or its technology and communication service providers.
Each Recipient affirms that they:
• Are the owner or authorized user of the contact information provided below.
• Are authorized to consent to receive such communications under all applicable laws.
4. Revocation of Consent
Each Recipient may revoke consent at any time by notifying Maintestream in writing or replying
"STOP" to text messages. Maintestream will promptly remove the Recipient from all further
electronic communications, except where otherwise required to fulfill contractual service terms.
5. Compliance Acknowledgement
Each Recipient acknowledges and agrees that:
• Maintestream will maintain a log of consent records as required by the TCPA, CAN-
SPAM, and relevant state and federal communications laws.
• This consent does not create a contractual service relationship with the Recipient. The
contractual relationship remains between Maintestream and the Client.
• Each Recipient remains responsible for updating Maintestream if their contact
information changes.
6. Governing Law
This Agreement shall be governed and interpreted in accordance with the laws of the State of
Texas and applicable federal communication laws.
7. Acknowledgment and Consent
By accessing or using Maintestream’s website, products, services, systems, and any associated third-party platforms or integrations, each Recipient certifies they have read and understood this Agreement and
voluntarily consent to electronic communications and automated electronic communications
such as but not limited to text messages and emails, from Maintestream, its technology, systems,
automated systems, employees, affiliates, third parties, and/or communications service provider(s.
